Allstate Adjusters Overtime Suit

Nettles, et al. v. Allstate Insurance Co., et al.
(Cook County Illinois Circuit Court Case No. 02 CH 14426)

Daniel J. Gatti and co-counsel are pursuing a class action claim on the behalf of Allstate Adjusters who worked overtime but never received their due compensation. Cook County Judge Quinn has heard the facts of this case and has granted class certification to casualty and auto-property adjusters who worked in the state of Illinois from August 8th, 1999 to present. Diminished Value In Oregon

Gonzales, et al., v. Farmers Insurance Co., et al.
(Multnomah Circuit Case No. 9910-11479)

In December 2006, Daniel J. Gatti and co-counsel secured a favorable decision by the Oregon Court of Appeals which found that insurance policies issued by Farmers Insurance do not preclude Farmers-insureds from collecting monies for diminished value to their vehicles following a car accident. Plaintiffs have argued that when a car is damaged in a wreck, even if it is properly repaired, there is inherent diminishment in value to that vehicle, and Farmers-insureds should be compensated for this loss. Following the Court of Appeals decision, the case shall be remanded to Multnomah Circuit Court where plaintiffs will seek class certification for all Farmers-insureds in Oregon who suffered a diminishment in value to their vehicles from 1993 to present.
